This website is operated by The Pit Stop. Throughout the site, the terms “we”, “us” and “our” refer to The Pit Stop. The Pit Stop offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

 

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. 

 

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. 

 

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. 

 

ONLINE STORE TERMS 

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. 

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 

You may not use, share or otherwise exploit the Website or the Services for any commercial, business or monetised purpose whatsoever;

You may not reproduce, duplicate, copy, share or re-sell any part of the Website or the Services in contravention of these Term

You must not transmit any viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of the Website and/or the Services; or

  • access without authority, interfere with, damage or disrupt: (a) any part of the Website; (b) any equipment or network on which the Website is stored; (c) any software used in the provision of the Website; or (d) any equipment, network or software owned or used by any third party,

(together, the Acceptable Use Restrictions). 

A breach or violation of any of the Terms will result in an immediate termination of your Services. 

 PRICE AND PAYMENT

All Website users are able to place orders for the products. An Order can be submitted by making your selection on the Website and clicking on the ‘Buy Now' button. The Website allows you to review your Order and make any corrections before submitting it to us. By submitting the Order you confirm that you have made any such corrections.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

No Order is accepted by The Pit Stop until the Website displays an order confirmation message.

The price of the Products will be the price indicated on the Website. The Price stated excludes any discounts and delivery charges, which will be calculated at checkout. You authorise us and Shopify to take payments and/or charge your payment card for the relevant amounts.

If you place an Order for a Magazine Subscription, the Price covers four individual issues which are issued on a quarterly basis. 

We accept the following cards for payment: Visa, American Express, MasterCard and Maestro. By paying using your credit or debit card you confirm that the card is yours. We also accept payment using Shop Pay, and Apple Pay and Google Pay on supported devices. You confirm that there are sufficient funds or credit available to meet your Order.

Payments for all Products will be charged immediately on confirmation of your Order by us. Dispatch of your Order is subject to our being able to charge your payment card.

We reserve the right to change the Price of all Products at any time and all revised Prices will be detailed on the website as soon as the Price change has taken effect.

DELIVERY

The delivery costs will be as indicated to you at the checkout stage on the Website.

If delivery of the Products is delayed by an event outside of our control, we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by this event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any Products you have paid for but not received.

YOUR RIGHTS TO END THE CONTRACT

You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

Your rights on cancellation of the contract will depend on what products you have ordered and when you decide to end the contract with us.

 

ENDING THE CONTRACT BECAUSE OF A CHANGE MADE BY US

If you are ending the contract between us for any of the following reasons, the contract between us will end immediately and we will refund you for any Products which have not been provided:

  • we have told you about an upcoming alteration to the Product which you do not agree to;
  • there is a risk that delivery of the Products may be significantly delayed because of events outside our control;
  • you have a legal right to end the contract because of something we have done wrong.

CANCELLING AN ORDER

Single Issue

In relation to Single Issues which you have ordered, we will offer you the right to cancel the contract of an unopened Single Issue during the 14 day period after the day on which you or a third party indicated by you received the Single Issue.

Magazine Subscription

In relation to Magazine Subscriptions which you have ordered, you have the right to change your mind and cancel the contract during the 14 day period after the day on which you or a third party indicated by you receives, the first of the four individual issues which forms part of the Magazine Subscription.

HOW TO END THE CONTRACT WITH US 

To end the contract with us, please let us know by doing one of the following:

  • Call us on 07385 846953 or email us at mailroom@thepitstopmagazine.com, providing your full name, details of the Order, your phone number and your email address.

We will refund you the Price you paid for the Products by the method you used for payment. However, if you are exercising your right to change your mind:

  • We may reduce your refund of the Price (excluding delivery costs) to reflect any reduction in the value of the Products, if this has been caused by you handling the Products in an unreasonable manner. 
  • The maximum refund for delivery costs will be the cost of delivery by the least expensive delivery method we offer. 

We will make any refunds due to you as soon as possible and if you are exercising your right to change your mind then your refund will be made within 14 days from the day on which we receive the Product back from you.

QUESTIONS/COMPLAINTS

We can only replace products if they are damaged or defective. If you think you are eligible for a replacement, please call us on 07385 846953 or email us at mailroom@thepitstopmagazine.com and if a replacement is agreed, post the product to the address we provide you. Where the product is proven to be damaged or defective (to be determined in our reasonable discretion) we will issue a replacement free of charge.

OUR RIGHTS TO END THE CONTRACT

We may end the contract between us, and/or your rights under these Terms, immediately on notice to you if:

  • you do not make any payment to us when it is due and you still do not make payment within 7 days of us reminding you that payment is due;
  • we believe that your use of the Website and/or the Services is unsuitable in any way;
  • you breach any of the Acceptable Use Restrictions;
  • you are otherwise in breach of these Terms.

In the unlikely event that The Pit Stop is unable to fulfil a subscription for any reason, a refund equal to the goods and services not received shall be made.

If you or we end your rights under these Terms, you must immediately stop all activities authorised by these Terms, including, without limitation, your access to the Website and the Services.

INTELLECTUAL PROPERTY RIGHTS

The copyright and all other rights in all of the material on this site are owned by The Pit Stop or the material is included with the permission of the rights owner. You have no rights in, or to, the Content other than the right to use the Content strictly in accordance with these Terms and you may not copy, adapt, display, share, communicate to the public or otherwise use any Content, except as enabled and permitted by the Website, the Services and these Terms from time to time.  

 

ERRORS, INACCURACIES AND OMISSIONS

 

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

 

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

 

LIMITATION OF LIABILITY

We do not exclude or limit our liability to you where it would be unlawful to do so. 

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

 

In no case shall The Pit Stop, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

 

We provide the Website, the Services and the Products for domestic and private use only. You agree not to use the Website, the Services or the Products for any commercial or business purposes, and we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
